Environmental Due Diligence
For almost a decade, Guernsey has been assisting Hobby Lobby Creative Centers (Hobby Lobby) with environmental due diligence associated with acquisition and other real estate transactions for scores of facilities throughout the United States.
These facilities generally include vacant land, commercial buildings, and religious centers. To date, Guernsey has performed over 60 Phase I Environmental Site Assessments (ESAs).
The ESAs are accomplished in accordance with applicable ASTM standards and address potential site contamination, adjacent land use issues, and regulatory compliance concerns. Several environmental issues are identified during the due diligence process. Some of the more important issues outlined in the ESAs include:
- Storm water drainage
- Environmental compliance
- Polychlorinated biphenyls (PCBs)
- Asbestos
- Lead-based paint
- Underground storage tanks
- Hazardous materials management
- Adjacent wetlands
- Previous environmental investigations
- Adjacent groundwater contamination
- Historical land use
These ESAs assist Hobby Lobby in determining and evaluating liabilities associated with current and past usage of the facilities and adjacent properties.
